1. Scope

This Acceptable Use Policy (“AUP”) applies to all web-hosting, domain-registration, web-design and related services (“Services”) provided by MaltaCode, a sole proprietorship registered in Malta and operated by Dick Impens. It covers every individual or organisation (“User”) that purchases, accesses or otherwise uses the Services, including any third parties or sub-users who access the Services through a User’s account.

2. Permitted use

Users may use the Services for any lawful purpose that is consistent with the service plan they have purchased. Typical permitted uses include hosting websites, storing files related to those websites, sending transactional email and registering domain names.

3. Prohibited use

The following activities are strictly prohibited on any MaltaCode service:

  • Distributing malware, viruses or any other harmful code
  • Sending unsolicited bulk email (spam) or operating open mail relays
  • Hosting phishing pages or any content designed to fraudulently obtain personal information
  • Hosting or distributing child sexual abuse material (CSAM) or any content that exploits minors
  • Infringing on intellectual property rights, including hosting pirated software, media or other copyrighted material without authorisation
  • Running cryptocurrency mining software or processes
  • Launching or facilitating denial-of-service (DoS/DDoS) attacks
  • Port scanning, network probing or any form of unauthorised access to other systems
  • Hosting content that incites violence, terrorism or hatred against any group
  • Operating illegal gambling, unlicensed pharmaceutical sales or any activity that violates applicable law
  • Circumventing resource limits, security controls or access restrictions of the Services
  • Any activity that violates EU, Maltese or Dutch law, or the laws applicable in the User’s jurisdiction

4. Compliance with laws and sanctions

Users must comply with all applicable local, national and international laws and regulations when using the Services. This includes, but is not limited to, EU data-protection regulations (GDPR), anti-money-laundering directives and international sanctions programmes. MaltaCode will not knowingly provide Services to individuals, entities or countries that are subject to EU, UN or OFAC sanctions.

5. Responsibility for third parties and sub-users

The account holder is fully responsible for all activity that occurs under their account, including actions by employees, contractors or any other third party to whom access has been granted. If a User resells or shares access to the Services, the User must ensure that every sub-user complies with this AUP. Violations by a sub-user will be treated as violations by the account holder.

6. Monitoring and enforcement

MaltaCode reserves the right to monitor the use of its Services to the extent necessary to ensure compliance with this AUP and applicable law. If a violation is detected or reasonably suspected, MaltaCode may, at its sole discretion and without prior notice:

  • Issue a written warning requesting immediate corrective action
  • Temporarily suspend the User’s account or specific services
  • Remove or disable access to offending content
  • Permanently terminate the User’s account
  • Report the activity to the relevant law-enforcement authorities

Where possible, MaltaCode will notify the User before taking action and provide a reasonable opportunity to remedy the violation. However, in cases of severe or illegal activity, immediate action may be taken without prior notice.

8. Changes to this policy

MaltaCode may update this AUP from time to time. Material changes will be communicated via email or through the Client Portal. Continued use of the Services after a change takes effect constitutes acceptance of the revised policy.
